GENERAL CONDITIONS OF SALE

1. CUSTOMER REGISTRATION
In order to use the e-commerce service made available by Fratelli Del Fabbro srl, the Customer must enter their personal and fiscal data, a valid email address and a telephone number that can be contacted by the courier carrying out the transport.
The data entered by the Customer will be processed by Fratelli Del Fabbro srl in full compliance with the law as provided in the privacy policy

2. PURCHASE METHOD

The catalogs of the products available for purchase are all available on the page www.karndesign.it. For each product in the catalog there are:
a) Product description,
b) an image that in any case has a non-descriptive function but merely a simplification one.
c) available colors, useful dimensions.
c) the unit price;
Orders placed through the website www.karndesign.it will be considered completed only following the sending of an order confirmation by Fratelli Del Fabbro srl to the email address indicated by the Customer during registration.
By placing the order, the Customer declares to have read all the information provided during the purchase procedure and to have fully accepted these conditions of sale.
The order confirmation email will contain the order number itself, the type and quantities of the products requested, the billing information and those of the place where the goods will be delivered. In this regard, the Customer is invited to always check the correctness of such data and, in the event of an error, immediately notify F.lli Del Fabbro srl or by telephone or by email at info@delfabbro.org
The Customer can check the status of his orders at any time by contacting the offices at 0433.467492.
Fratelli Del Fabbro srl in any case reserves the right, at its discretion, to refuse orders placed. In case of non-acceptance of an order placed by a Customer, the same cannot claim any title, for this circumstance, any risk of compensation for contractual or extra-contractual damages, except for the reimbursement of any sums already paid.
Fratelli Del Fabbro srl reserves the right to modify the products included in the catalog and their list price at any time. These changes have no effect for orders already submitted.
Fratelli Del Fabbro srl keeps its online catalog updated by inserting new products and indicating those temporarily unavailable. Nevertheless, if, due to extraordinary circumstances, the availability of a product is no longer available immediately after sending the order, Fratelli Del Fabbro srl will promptly inform the Customer, via the email address indicated by the same at the registration office, of any unavailability.

3. PAYMENTS

Fratelli Del Fabbro srl will accept the following payment methods.
Pay Pal.
This payment method is managed directly by Pay Pal according to your regulations. Fratelli Del Fabbro srl consequently will not be aware of the data of the credit card used by the customer.
Advance bank transfer.
In the event that payment by advance bank transfer is chosen, the Customer must make the corresponding payment on the same day to the bank account at the UNICREDIT SPA bank, in the name of Fratelli Del Fabbro srl and having

indicating as the reason the distinctive code received in the order confirmation itself.

Only after the actual crediting to the current account indicated, Fratelli Del Fabbro srl will send the order confirmation and ship it as indicated in paragraph no. 5 (Shipping).
If after 3 working days from sending the order the payment has not been credited to the current account previously indicated, Fratelli Del Fabbro srl will consider the order canceled.
Cash on delivery.
In the event that cash on delivery is chosen, the Customer will have to pay the amount indicated in the invoice for the order placed, directly to the courier upon delivery. Cash on delivery can be made in cash if the amount does not exceed € 1000.00 (The amount to be paid to the courier must be exact as it is not possible to leave a change.
In the event that the cash on delivery method of payment is chosen, the total amount of the order will include an increase of € 10.00.

4. BILLING
Fratelli Del Fabbro srl will issue a separate invoice for each order confirmation received by the customer, even if it includes several items.
The invoice will include the price of the individual products ordered, the VAT applied, shipping costs, additional additional costs related to specific forms of payment chosen by the Customer.
The invoice will be made out to the customer using the personal data that the same declared when registering on the site.
The invoice will be attached to the products and delivered by the express courier together with them.

5. SHIPPING
Fratelli Del Fabbro srl will ship the purchased products by delivery with the courier choosed.
– within 2 working days of sending the order confirmation email if cash on delivery has been chosen;
– within 2 working days of the actual receipt of the invoiced amount, in the event that payment by credit card or advance bank transfer has been chosen.
The ordered products will be delivered to the address indicated by the Customer at the time of registration, unless a different delivery address has been specified in the order.
Fratelli Del Fabbro srl is not responsible for the delivery times of the individual carriers indicated.
Delivery will be made on working days (Monday to Friday) with the exception of holidays and the day before holidays, and will be made not on the floor. Any deliveries to the floor must be requested from F.lli Del Fabbro srl who will charge the additional expense requested by the courier.
The goods will be shipped in packaging prepared directly by Fratelli Del Fabbro srl.
Upon receipt of the order, the Customer is required to verify that the number of packages delivered corresponds to that reported on the DDT, and that the packaging is intact.
In case of delivery of a lower number of packages than those indicated in the transport document, or if they are wet or damaged, the Customer must sign the delivery note with reserve, contesting these circumstances in writing on the delivery note, and notifying Fratelli. Del Fabbro srl through the “Contacts” page at the following contact address.
If, on the other hand, there is no correspondence between the order and delivery, the customer will not have to accept the goods, he will have to raise the dispute directly to the carrier and report the incident via the “Contacts” page at the following contact address.
If despite everything, the courier refuses to have it signed with reserve, the Customer will have to REJECT THE GOODS.
This procedure is the only solution that allows Fratelli Del Fabbro srl to immediately manage complaints with the courier and which allows you to quickly return any goods that may have arrived in an incomplete manner.
Please note that if the Customer, without following the procedures indicated above, signs the packing slip for acceptance, he will not be able to make any objection to the external characteristics of what was delivered to him in relation to the order placed.

6. DEFECTIVE PRODUCTS
With regard to any defects in the products purchased through the website www.delfabbro.org, the rules laid down by the Civil Code in Articles. 1490-1495, without prejudice to the applicability of the more favorable discipline introduced by Legislative Decree 206/2005 to Articles 128-135.
The Customer who intends to request the replacement of defective products, must necessarily send the same, complete with all their parts, together with the purchase invoice, the details of the order placed and the description of the defect found, to Fratelli Del Fabbro srl at the headquarters of Tolmezzo (UD), Via degli Artigiani 20 – CAP 33028.
Fratelli Del Fabbro srl reserves the right to verify the actual existence of the alleged defects and to replace / reprint only after this check.
The return shipping costs are charged to the customer.
In the event that the reported anomaly does not exist, Fratelli Del Fabbro srl reserves the right not to replace the existing goods.
The costs of returning the products – return – are borne by Fratelli Del Fabbro srl only in the event that the products are actually flawed

7. DISCLAIMER OF LIABILITY
In no case Fratelli Del Fabbro srl can be held responsible for delays or non-delivery due to negligence or in general the fault of the express courier, as well as to circumstances attributable to unforeseeable circumstances or force majeure.

8. WITHDRAWAL
The Customer, a natural person who acts for purposes unrelated to the activity or profession possibly carried out (Consumer), who makes purchases through the e-commerce service of the website www.karndesign.it may exercise the right of withdrawal in accordance with the articles 52-59 of Legislative Decree 206/2005 and subsequent amendments.
In particular, the Consumer has the right to withdraw from the contract without any penalty and without specifying the reason within 14 days of receipt of the purchased products.
The withdrawal must be made by the Consumer by sending, within the aforementioned deadline under penalty of forfeiture, to Fratelli Del Fabbro srl – Via degli Artigiani 20 – 33028 Tolmezzo (UD) a written communication sent by registered letter with notice of receipt using the model withdrawal model referred to in Annex A) or any other explicit declaration of the decision to withdraw from the contract. Proof of dispatch will be given by the post office delivery stamp of the letter. The communication may also be sent within the same term by telegram, telex, e-mail and fax, provided that within the following 48 hours it is confirmed by sending a registered letter with acknowledgment of receipt.
In the event that the Consumer intends to exercise the right of withdrawal after taking charge by the carrier, he will have to provide at his own risk and expense to return any purchased products received, intact and unused, complete with original packaging, by sending by express courier to Fratelli Del Fabbro srl – Via degli Artigiani 20 – 33028 Tolmezzo (UD) within 14 days from the date on which it communicated its intention to exercise the right of withdrawal. In any case, products that are damaged, used or returned to Fratelli Del Fabbro srl on delivery will not be accepted.
In the event that the Consumer activates the right of withdrawal, Fratelli Del Fabbro srl will refund all payments made by the Consumer within 14 days from the date on which it received a notice of withdrawal, with the exception of the costs of returning the goods, as well as any additional costs deriving from the Consumer’s choice to make use of a type of delivery other than the less expensive type offered by Fratelli Del Fabbro srl. The refund will be made with the same payment method used by the Consumer for the initial transaction unless otherwise agreed.

9. APPLICABLE LAW AND JURISDICTION
Purchase contracts finalized through the website www.karndesign.it are concluded in Italy, governed by Italian law and subject to Italian jurisdiction.
Any disputes concerning the validity or execution of the contracts concluded through this site and the interpretation of these conditions of sale, which may arise between Fratelli Del Fabbro srl and a customer with a VAT number will be devolved exclusively to the Court competent of Udine.
